Digital Service Act: proposed amendments adopted

The Internal Market and Consumer Protection Committee  of the EU Parliament has adopted proposals for amendments to the DSA. The DSA thus clears another hurdle. The compromise proposal is now to be voted on in EU Parliament as early as January 2022.

The substantive proposals concern the following points:

• "Erotic platforms": Uploading content there should only be allowed for users who have registered an email address and mobile phone number with the operator.
• Notice-and-action obligations in connection with particularly serious violations of the law (such as punishable radical hate comments, depictions of child abuse and copyright violations) are to be tightened.
• Authority orders against illegal content are to be limited to the territory of the ordering member state.
• With regard to advertising tracking and targeting, the compromise proposal contains a demand for more transparency, but no ban - as apparently put forward by other political groups. 
• As already demanded by the member states, the proposal contains a clause against so-called "dark patterns" (see our article here).
• The proposal should also grant platforms the right to end-to-end encryption.
