Luchterhand Verlag achieves stage victory in court with SKW Schwarz: “Innerstädtischer Tod” may continue to be distributed for the time being

The press chamber of the Hamburg Regional Court has rejected the application by the Berlin gallery owner couple König for an injunction against the novel “Innerstädtischer Tod” by Christoph Peters.

Johann and Lena König had applied to the court for an injunction against the distribution of the novel because they believed they recognized themselves in the fictional gallery owner character Konrad Raspe and his wife. They claimed that their personal rights had been violated.

The decision means that distribution of the book by Luchterhand Literaturverlag, a member of the Random House publishing group, remains permitted for the time being.

The court followed SKW Schwarz's argument that artistic freedom outweighed the asserted personal rights in this case.

The decision is not yet final.
